Employee Privacy Notice

This Employee Privacy Notice (“Privacy Notice”) explains how ASK Staffing Inc. (“ASK Staffing,” “we,” “us,” or “our”) collects, uses, retains, and shares your personal information during the course of your relationship with us, including any of our subsidiaries or affiliates.

I. APPLICABILITY

This Privacy Notice covers the personal information we collect from ASK Staffing Inc. personnel, including employees, individuals who have received conditional job offers, and anyone working on a non-permanent basis (such as temporary staff, contract workers, independent contractors, consultants, and interns).

II. COLLECTION, USE, AND RETENTION OF PERSONAL INFORMATION

In the course of your tenure with ASK Staffing, we collect personal information about you and, if necessary, about your spouse, emergency contacts, legal dependents, or family members (“Dependents”). If you provide us with personal information about any Dependents, you are responsible for informing them that you are sharing their information with us, explaining why, and ensuring they agree to this disclosure. Unless otherwise stated below, we retain personal information for seven (7) years or until we receive a request to delete it.

A. Information Collected From Employees

Throughout your tenure at ASK Staffing, we collect personal information for a variety of purposes:

  1. Conditional Job Offer
    • When you receive a conditional offer from ASK Staffing, we collect:
      • Personal identifiers: Name, email address, physical address, and telephone number
      • Professional/employment information: Résumé, cover letter, work and educational history, credentials, licenses
      • Criminal history
      • Sensitive personal information: Social Security number, date of birth, driver’s license/state ID/passport number
      • Protected categories: Race, gender, ethnicity, disability status, military or veteran status/spouse status, age range
      • Vaccination status (including documentation, if applicable)
      • Health information: Pre-employment screening results, vaccination status
      • Tax information: Federal and state tax forms
      • Work authorization status
      • Emergency contact information
      • Payment information: Bank details (routing and account number)
    • We use this information to conduct pre-employment screenings, verify work authorization, and comply with applicable laws.
  1. Administer Compensation and/or Benefits
    • We may collect from you (and in some cases from government entities):
      • Identifiers: Name, telephone number, physical address, email address (if provided), date of birth
      • Sensitive personal information: Social Security number, driver’s license number, state ID number, passport (if provided)
      • Protected classifications: Marital status, age, gender, disability status (if provided), veteran status (if provided)
      • Beneficiary information: Name, telephone number, email address, date of birth, Social Security number
      • Health information: ADA, FMLA, and workplace accommodation details (if applicable)
      • Financial information: Bank account and routing number
      • Professional/employment information: Hours worked, meal and rest breaks
    • We use this to administer wages and benefits (e.g., medical, dental, retirement). If you elect coverage for Dependents, we collect their identifiers (name, telephone, address, email, date of birth), protected categories (marital status, gender), and sensitive personal information (Social Security number) for benefits eligibility and administration.
    • For independent contractors, we collect W-9 information, business name/registration data, Social Security number or Taxpayer Identification Number (TIN), and any applicable insurance policy information.
  1. Administer Reimbursements
    We collect from you, and from our payment card vendors, personal identifiers (name, physical address), financial information (bank account, routing number), corporate financial information (ASK Staffing-issued credit card), and details of expenses or travel through our travel service. We use this information to process reimbursements.
  2. Career Development
    We collect, from you, personal identifiers (name) and professional or employment-related information (licenses, credentials, work history, performance reviews, etc.), as well as educational information (institution attended). This is used to identify, deliver, and track training, support career development, and manage licenses and certifications.
  3. Conduct Performance Reviews
    We collect from you personal identifiers (name), professional information (credentials, educational history, résumé) and create inferences (e.g., overall or future performance). We use this data to evaluate your performance and assess suitability for internal opportunities.
  4. Conduct Background Checks
    We collect your identifiers (name, address history, date of birth), criminal history, and sensitive personal information (Social Security number). We also may obtain your credit report from third-party credit reporting agencies (open lines of credit, outstanding balances, loans, bankruptcies, etc.). We use this information to evaluate fitness for the role.
  5. Create a Personnel File
    We collect from you personal identifiers (name, date of birth, phone number, address), commercial information (credit report, employment and education history, references), health information (vaccination status), emergency contact data, referral details, and professional or employment information (licenses, credentials, performance reviews, etc.). We use this to maintain a personnel file, create internal personnel biographies, and consider you for other roles within ASK Staffing.
  6. Handle General Human Resources Functions
    We collect from you your identifiers (name, email, phone, address), protected categories (work authorization status), and information about Dependents (name, address, email, phone, marital or family status) to handle HR matters such as onboarding, terminations, and emergency contact procedures.
  7. Issue Tax Forms
    We collect identifiers (name, address, Social Security number, date of birth) and tax information (marital status, withholding details) to comply with tax reporting requirements.
  8. Monitor Compliance With Equal Opportunities and Anti-Discrimination Laws
    We collect from you, government entities, and background check providers your protected classifications (race, color, national origin, sex, veteran status, etc.) to ensure compliance with equal employment opportunity and anti-discrimination laws.
  9. Monitor Work-Related Licenses and Credentials
    We collect your identifiers (name) and professional information (licenses, credentials, résumé) from you, educational institutions, and references to verify and manage licenses and credentials.
  10. Promote Safety and Security
    We collect from you and automatically via closed-circuit cameras your photographs or video images for security badges and to maintain a safe environment for all employees, contractors, visitors, and clients.
  11. Participate in Recorded Telephone/Video Calls
    We may collect from you your physical appearance (video) and voice (audio) during recorded phone lines or videoconferences for communication, compliance, training, and quality assurance purposes.
  12. Implement Diversity, Equality, and Inclusion Program
    With your consent, we collect your protected category information (race, color, national origin, gender identity, sexual orientation, veteran status, etc.) to foster and administer our diversity, equality, and inclusion initiatives.

B. Information We Collect From Third Parties

During your tenure at ASK Staffing, we may collect personal information from third parties for certain employment-related purposes:

  1. Verify Your Education
    We collect non-public educational information (e.g., verification of institutions or dates) from you, background check providers, and educational institutions.
  2. Verify Your Employment History
    We collect employment history details from your previous employers to ensure accuracy.
  3. Review Drug Test Results
    When required, we receive drug test results from the testing provider (health information about illegal substances). If necessary, we may request medical marijuana card information for verification.
  4. Information From References
    We collect professional or employment information and references’ impressions of your abilities to evaluate suitability for a role.
  5. Health or Vaccination Providers
    We collect conclusions about your health or vaccination status (pass/fail, vaccination proof) from relevant providers to fulfill our health and safety requirements.

C. Information We Collect Automatically via Cookies and Other Trackers

When you use ASK Staffing systems, we automatically collect certain personal information:

  1. Internet and electronic network activity (e.g., username, password, IP address, browsing history, search history) to ensure compliance with company policies, maintain security, and provide IT support.
  2. Electronic communications (e.g., phone recordings, email, instant messages) sent from or received on ASK Staffing devices for security, compliance, and support.

III. HOW WE SHARE YOUR PERSONAL INFORMATION

General Sharing

  1. Within ASK Staffing
    We share personal information internally on a need-to-know basis for IT services, HR, accounting, and general business and employment operations.
  2. With Service Providers
    We share information with service providers who assist with employment administration (e.g., IT support, payroll, healthcare/benefits management, legal counsel).
  3. With Third Parties
    We may share personal information with legal advisors, law enforcement, or government bodies to protect our rights, investigate or prevent fraud/illegal activity, or comply with legal obligations.
  4. During a Corporate Reorganization
    If we undergo a reorganization, merger, acquisition, or similar transaction, your information may be transferred as part of the business assets.
  5. With Our Clients or Managed Service Providers
    We may share your information with the specific client(s) you are assigned to, or with Managed Service Providers who coordinate between us and the client.
  6. Legal Purposes
    We disclose personal information if legally required (court orders, law enforcement requests, legal claims, etc.) or to exercise or defend legal rights.

Sharing in the Preceding Twelve (12) Months

    • For Business Purposes
      In the last twelve (12) months, we have disclosed personal identifiers, protected classifications, employment information, and internet activity information to service providers (IT support, background checks, payroll, etc.) who facilitate employment processes, benefits, or IT security.
    • For Sale or Sharing
      ASK Staffing does not sell or share personal information of its personnel.

IV. RIGHTS OF CALIFORNIA EMPLOYEES

If you are a California resident, you may have certain rights under the California Privacy Rights Act (CPRA):

  1. Right to Access/Know
    You may request details on the personal information we have collected, used, disclosed, or sold about you.
  2. Right to Deletion
    You can request that we delete your personal information, subject to legal exceptions.
  3. Right to Opt-Out of Sale/Sharing
    You may opt out of the sale or sharing of your personal information. ASK Staffing does not sell or share personal information of its personnel.
  4. Right to Non-Discrimination
    We will not discriminate against you for exercising any CPRA rights.
  5. Right to Correct
    You can request that we correct inaccurate personal information we hold about you.


To exercise these rights, please submit a request via phone at 1-770-813-8947 or email privacy@askconsulting.com. Alternatively, you may visit our California Privacy Rights Act page. For verification, we may ask for enough information to confirm that you are the individual about whom we collected personal data.

Using an Authorized Agent

If you use an authorized agent to submit CPRA/CCPA privacy requests on your behalf, the following applies:

    • Without Power of Attorney
      Provide signed permission stating the specific requests (access/deletion). The consumer (employee) must verify identity directly with us (e.g., by providing a government-issued ID or Social Security card).
    • With Power of Attorney
      Provide a valid power of attorney under California Probate Code sections 4000–4465.
    • Opt-Out Requests
      Provide written permission, signed by the employee, authorizing the agent to submit an opt-out request.

V. SECURITY

We use reasonable measures (encryption, access controls, employee training, etc.) to safeguard personal information. However, no system or data transmission over the internet can be guaranteed fully secure, and we cannot warrant the absolute security of your information.

VI. CHANGES TO THIS PRIVACY NOTICE

We may update this Privacy Notice at our discretion. Any changes will be announced via email and on our website, along with the effective date. If material changes affect your privacy rights, we will notify you and obtain your consent where required.
